Legal and practical aspects of the use of direct coercive measures in the Prison Service

Celem niniejszej pracy licencjackiej jest analiza prawnych oraz praktycznych
aspektów stosowania środków przymusu bezpośredniego (dalej: ŚPB) przez
funkcjonariuszy Służby Więziennej (dalej: SW). Praca obejmuje analizę obowiązujących
przepisów prawa krajowego i międzynarodowego, ocenę ich korelacji, oraz praktycznego
zastosowania regulacji prawnych w jednostkach penitencjarnych. W części empirycznej
przeprowadzono badanie ankietowe wśród funkcjonariuszy SW, którego celem było
poznanie poziomu wiedzy respondentów na temat przepisów dotyczących ŚPB,
częstotliwości ich stosowania, opinii na temat szkoleń oraz wpływu ŚPB na relacje
z osadzonymi. Badanie umożliwiło sformułowanie wniosków dotyczących oceny
zasadności stosowania przepisów prawnych w aspekcie stosowania ŚPB w warunkach
jednostek penitencjarnych.
W kontekście stosowania przymusu w środowisku więziennym, autor pracy
zwraca uwagę na złożony i delikatny charakter tego zagadnienia oraz wskazuje potrzebę
dalszych analiz, szczególnie w obszarze doskonalenia praktyk szkoleniowych i procedur
nadzorczych.

The aim of this bachelor's thesis is to analyse the legal and practical aspects of
the use of direct coercive measures (DCM) by officers of the Prison Service. The thesis
includes a review of the applicable provisions of national and international law, an
assessment of their consistency and application in the practice of penitentiary units. In the
empirical part, a survey was conducted among officers of the Prison Service, the aim of
which was to learn about the level of knowledge of respondents about the regulations
concerning DCM, the frequency of their use, opinions on training and the impact of DCM
on relations with prisoners. The study allowed for the formulation of conclusions
regarding the perception of the adequacy of legal provisions and practical aspects of the
use of DCM in the conditions of penitentiary units.
The thesis shows the complexity and sensitivity of the issue of the use of
coercion in the prison environment. It also indicates areas requiring further analysis,
including the improvement of training and supervisory procedures.
